Sex on pretext of marriage not always rape: Delhi High Court

While dismissing the appeal of a woman, who had challenged the acquittal of a rape accused on the pretext of marriage, the Delhi High Court, on Tuesday, claimed that promise of marriage couldn’t be held as an inducement for engaging in sex over a protracted and indefinite period of time. 

Inducement to have a physical relationship by promising marriage and the victim falling prey to such an inducement may be understandable in the context of the moment. A promise of marriage cannot be held as an inducement for engaging in sex over a protracted and indefinite period of time, the court said. 
Justice Vibhu Bakhru, courting a single-judge bench, said that inducement to have a physical relationship by promising marriage and the victim falling prey to such inducement might be understandable in the context of the moment. 
On August 15, 2015, the complainant had filed a report at Malviya Nagar Police Station in Delhi, alleging that the accused had promised to marry her. 
However, after several complications, the accused left her and later got married to another woman. 
According to the court, there was no dispute between the woman and the accused and their relationship was consensual. 
Justice Bakhru also claimed that the complainants allegation of the accused giving her promise of marriage was not sustainable.
As noted by the trial court, according to her complaint, the appellant woman stated that she had a physical relationship with the accused in 2008 and after three or four months, thereafter, he had promised to marry her and she had eloped with him.

In view of the said statement, her allegation that her consent to engage in sexual activity with the accused, is vitiated, as the same were secured on a promise to get married, is not sustainable, the court said.
