In a first, a court in Chennai has awarded Rs 15 lakh as compensation to a man who was falsely accused of rape and faced trial for more than seven years. A man Santhosh was arrested on charges of rape when he was a college student.
Santhosh, who was acquitted in the case after DNA test proved that he was not the father of the child the woman delivered, sought Rs 30 lakh in damages from the girl, her parents, and the secretariat colony police inspector who investigated the case, after he was acquitted in the court.
Santhosh’s and the woman’s family were neighbors and belong to the same community. When Santhosh was studying BTech in an engineering college, the woman’s mother alleged that Santhosh had impregnated her daughter and should marry her. When Santhosh denied, the woman’s parents lodged a complaint of rape against Santhosh.
Santhosh was arrested and was kept in judicial custody for 95 days. On February 10, 2010, he was released on bail. After the woman delivered the child, a DNA test proved that Santhosh was not the father of the child. After the case went on trial, a mahila court acquitted Santhosh of the charges on February 10, 2016. Thereafter he filed a suit for damages.
