Ex-MLA Ashok Dhawads bail rejected, prosecution presents incorrect details about his COVID-19 treatment in High Court

Advocate Devendra Chauhan said that the Additional Public Prosecutor made false statement before High Court in ex-MLA Ashok Dhawads bail case.

Nagpur bench of Bombay High Court on Monday (August 10, 2020) refused to grant temporary bail to ex-MLA and former Chairman at Navodaya Urban Co-operative Bank Ashok Dhawad. The 65-year-old had sought temporary bail on health grounds for being COVID-19 positive and on going heart ailments, as Nagpur Central Jail became the biggest COVID-19 hotspot of the city ever since the lockdown began.

However, Dhawad, who is currently lodged at Nagpur Central Jail, was discharged from GMCH from August 9, 2020 despite being COVID-19 positive.

Several newspapers dated August 11, reported that Dhawad is currently undergoing treatment in Ward number 49 at GMCH. It should be noted that the former MLA was shifted back to Nagpur Central Jail on August 9, a day before his hearing at the High Court before Justice GM Giratkar.

Additional Public Prosecutor (APP) Prakash Tembhare said that Dhawad was receiving COVID-19 treatment at GMCH. However, contrary to APPs claims, Dhawad hasn’t been receiving any COVID-19 treatment and isn’t admitted at GMCH.

Justice GM Giratkar asserted that GMCH was the best hospital for COVID-19 treatment as compared to any private hospital in the city. The judgement came in despite the advocate Devendra Chauhans vehement appeal to the judge that Dhawad was no longer receiving any COVID-19 treatment at GMCH and was instead relocated to Nagpur Central Jail.

When we spoke to advocate Chauhan, he said, The court wasn’t provided with the facts; APP made an incorrect statement before the court. I requested for an affidavit too. The court was told about applicant (Ashok Dhawad) being in GMCH on August 7th. The matter was heard on August 10th. Even though he was discharged on August 9 and shifted to prison, the High Court was told that he was still undergoing treatment on August 10.. I kept telling Honourable judge that the applicant hadn’t even tested COVID negative. But still the judgment wasn’t passed in our favour.
